Items in stock are usually available on a next day delivery schedule. If next day delivery is imperative, please contact our sales office who will be happy to assist you. Items that are not in stock may still be purchased, but lead times on delivery will differ depending on supplier stock levels and delivery.
CONTRACT OF SALE:
Once you have placed your order, you should receive an e-mail from us acknowledging that we have received your order (but please contact us if you do not receive this e-mail). Please note this does not mean that your order has been accepted. All orders are subject to availability and acceptance by us which we may refuse for any reason.
After you submit your order, we immediately contact your bank or card issuer for authorisation to take payment from your account. We will not process your order until payment has been received in full. If we accept your order We will confirm this to you by sending you a further e-mail confirming the Product is being processed ready for dispatch at which point the contract between us ("Contract") will be formed.
As soon as you place your order, we start to process your order which means you will not be able to change it before delivery, but you may be able to return it under our Returns Policy.
From time to time We may make minor changes to a Product to reflect changes in relevant laws and regulatory requirements. These terms and conditions, and any Contract between us, are only in the English language.
Our standard times of delivery are: 8.30am to 5.00pm Monday to Friday.
Please note that someone must be available to sign for the delivery and AJ Stuart cannot be held responsible for delayed deliveries due to inaccessible sites or no one being available to sign for the goods. Please advise of any special delivery requirements at the time of order and our sales team will endeavour to fulfil them. Special deliveries and timed services are available at an extra cost.
Deliveries to Islands off mainland Ireland and UK are ensured in 48 hours due to extra shipping requirements.
DELIVERY TERMS ARE AS FOLLOWS:
All online orders under £75 Excluding VAT are subject to a carriage and packing charge of £5 Excluding VAT
Orders made by deadline 12pm Monday to Friday will usually be delivered the next working day, any order made after the deadline will take 2 working days t be delivered.
HEAVY EQUIPMENT & FURNITURE
Delivery of machines, refrigeration, furniture and all flat-pack items will be made to the ground floor entrance to the building. It does not include negotiating lifts or stairs.
Customers are responsible for ensuring that products ordered will fit through doorways and into their premises. We cannot accept responsibility if it will not fit. Any carriage charges caused by an aborted delivery are the customer's responsibility.
Delivery does not include removal of unpacking or positioning or assembling items.
The company will only accept returns where we have dispatched the wrong item or if the goods are damaged. If goods are damaged but can not be returned, photographic evidence will be needed before a credit can be issued.
Goods returned for reasons other than where we have dispatched the wrong item or if the goods are damaged will be subject to the following: (a) 20% freight & handling charge. Minimum charge of €20.00 (b) Non stock (special order items) may not be returned.
All returns must be notified to the AJ Stuarts Ltd sales office (Telephone 028 9077 6808) within 3 days of receipt of goods. Credit will only be given on goods returned in their original packaging & condition.
WARRANTIES & REPAIRS
AJ Stuart warrant that all goods supplied by it will correspond to their specification and will be free from defects in materials or workmanship for a period of 12 months from the date of delivery. AJ Stuarts’s obligation in the event of a breach of this warranty is limited to the repair or replacement of any defective goods, which shall be returned to AJ Stuart. by the customer. This warranty is given in lieu of all other warranties or conditions expressed or implied whether by statute or otherwise) and is subject to the following conditions:
Claims must be notified in writing to AJ Stuart within 24 hours from the date of delivery.
AJ Stuart shall be under no liability in respect of any defect in the goods arising from any drawing, design or specification supplied by the customer.
AJ Stuart shall be under no liability if the defect or failure, in the reasonable opinion of AJ Stuart, arises from wilful damage or misuse, negligence by the customer or any third party, failure to follow AJ Stuart’s instructions, or alteration or repair of the goods without AJ Stuart’s prior approval.
AJ Stuart shall be under no liability if the price for the goods has not been paid by the due date for payment.
The above warranty does not extend to parts, materials or equipment not manufactured by AJ Stuart., in respect of which the customer shall be entitled only to benefit of any such warranty or guarantee as is given by the manufacturer to AJ Stuart.
Except in the case of death or personal injury caused by AJ Stuart’s negligence, AJ Stuart shall not be liable for any consequential loss or damage (whether for loss of profit or otherwise) or other claims for consequential compensation.
